Terms of Use

These Terms of Use are mutually agreed upon by the Participant of the program (hereafter referred to as "the Participant") and MindEye Performance, LLC and it's representatives (hereafter referred to as "the School"). The School aims to provide the Participant with a coaching program. This program is intended for the participant only.

1. Terms

By accessing this School and courses with this School, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

These Terms of Use obligates the School to deliver the coaching program in exchange for payment from the Participant, as described in the Payment Terms section. The Participant further understands that there is work that is expected to come from the Participant to produce actual personal development.

Moreover, the Participant understands that all the Terms of Use are binding. The Participant is required to pay the full amount of the coaching program cost for the entirety of the coaching program specified in these Terms of Use whether the Participant denies or accepts the services once these Terms of Use have been accepted by the Participant.

2. Use License

  1. Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
  2. modify or copy the materials;
  3. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  4. attempt to decompile or reverse engineer any software contained on the School’s web site;
  5. remove any copyright or other proprietary notations from the materials; or
  6. transfer the materials to another person or 'mirror' the materials on any other server.
  7. Share any course material (exercises, videos, etc.) with anyone.. This includes any physical copy or electronic sharing.
  8. disclose the School's strategies or methods to any other party
  9. record any scheduled meetings/coaching sessions/group coaching sessions.
  10. This license shall automatically terminate if you violate any of these restrictions and may be terminated by the School at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Non-Disclosure Agreement

The School is sharing with the Participant contemporary, proven coaching strategies. The Participant must not disclose the School’s strategies or methods to any other party and no recordings are allowed to be made as outlined above in the Use License section. The Participant also agrees to take reasonable care to guard any personal usernames, login details and to take reasonable steps to ensure that no party other than the School directly discloses personal coaching to, may have access to the School’s recommendations of personal development practice. The Participant understands that these logins are for the Participant’s use only. If the Participant publishes information given to the Participant or make the Participant’s personal logins available without written permission or if the Participant recreates any parts of the strategies learned through the School, or any of its representatives using the Participant’s own likeness, brand, or personality for commercial or non-commercial gain, the Participant will be responsible for the School’s losses and damages.

4. Consent to Receiving Email Communication

The School's main modality of contact with its Participants is email communication. By accepting the Terms of Use, The Participant agrees to receive email communication from the School. The School will send emails to the email address provided by the Participant.

5. Disclaimer

The materials on the School’s website are provided 'as is'. The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

6. Participation Expectation

The Participant agrees to take action in his/her own personal development by demonstrating a consistent utilization of the new skills, tools, and methodology provided by the Scholl as evidenced by, but not limited to, the following:

  • Completing all activities at Participant's own pace
  • Completing the activities honestly, thoughtfully, and completely
  • Be open to feedback, and be honest with the School's coaches
  • Take active ownership in getting what is needed out of the program
  • Practice new behaviors, suspend judgement, ask questions for clarity, and utilize empathy
  • Challenge the School's coaches when necessary for personal learning, development, and change purposes

7. Limitations

In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized of the School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

8. Services Provided

The Participant accepts that all life and businesses decisions carry a risk; the Participant will always be in total control of the Participant’s capital and will always be in a position to control the Participant’s risk throughout the Participant’s involvement with the School. In order to enter these Terms of Use, the Participant must be in a position to actually be comfortable with the risks of spending monetary resources and must not spend these monetary resources unless the Participant is comfortable with the risk.

The Participant is aware that any results that have or will be mentioned by the School are results of past actions and though accurate, they are not demonstrative of expected changes or results with the Participant.

The Participant understands that the School may, in exigent circumstances, cancel any scheduled meetings. Such changes may be made by the School without notice to the Participant. The School notes that such cancellations are deemed by the School to be unlikely and the School will give as much notice whenever reasonably possible and reschedule accordingly.

9. Liability

The Participant agrees that all representations of the School representatives are deemed to be representations made by the School itself and all liability falls exclusively on the Participant. In the event of any claim against the School that is directly related to the services mentioned in these Terms of Use, no staff, agents, associates, partners and representatives of the School may be held liable. To be clear, the Participant agrees to indemnify any staff/ employees/ representatives of the School in the event of any lawsuit stemming from the activities referenced in these Terms of Use.

10. Earnings Disclaimer

As a company coaching people who may or may not own their own business, the School is required to give the Participant these disclaimers: The amount of business profitability and revenue the School’s methodology generates can increase or decrease. The School and any term used to reference this company, is an unregulated service. Recommendations are based solely on information derived from best practices and results may vary from business to business depending on several factors. All decisions are the sole responsibility of the Participant. Therefore, the School will not be held liable for any incurred losses. Further, the Participant should not buy a service unless the Participant is prepared to sustain a total loss of the premium plus any commission or other transaction charges.

11. Revisions and Errata

The materials appearing on the School’s website may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.

12. Links

The Participant agrees to not hold the School liable for any and all external links posted throughout the School's content and Facebook Private Groups. These links are not controlled by the School and therefore the School will not maintain the links.

13. Site Terms of Use Modifications

The School may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.

14. Governing Law

Any claim relating to the School’s website shall be governed by the laws of the School Owner’s home jurisdiction without regard to its conflict of law provisions.

15. Testimonial

In the event the School requests a testimonial for services rendered to be displayed on the School's website, FaceBook and/or Instagram page, printed marketing materials, etc, the Participant agrees to provide the testimonial within two (2) weeks of the request. The testimonial will include the Participant’s experience with the School and the overall satisfaction with services received. The School will provide the Participant with formatting guidelines for any and all requested testimonials.

16. Termination of Services

The School requires cooperation from the Participant in order to execute the School’s responsibilities. The Participant is expected to act with a reasonable level of professional respect toward the School. The Participant understands that if the Participant shows a lack of respect to the School’s team, the Participant will receive a written warning. Should the Participant show a lack of respect toward the School’s team after the delivery of the written warning, a request will be made to immediately end the services and Terms of Use between the Participant and the School. Such termination does not excuse the Participant from payment in full and any outstanding balances.

17. Refund Policy

Any and all amounts tendered by the Participant to the School or that are required to be tendered once these Terms of Use are executed are non-refundable.

The Participant agrees to waive and relinquish any and all options and rights to claim a pro-rated refund or hold the School liable in any event.

19. Independence

The Participant has fully assessed the risks and all parts of the aforementioned services offered by the School completed all due diligence on researching the offerings mentioned in these Terms of Use and has independently made the decision to become the Participant.
